Stalker gets 17 months jail for phone calls

A repeat stalker from Salzburg who despite seven court appearances has not stopped making nuisance phone calls to women has been jailed for 17 months.

After his release from jail on seventeenth of September until he was arrested again on 3 October Roland Sulzberger had managed to target four women with 20 telephone calls late at night.

As a result the 48-year-old unemployed man was in court again in Salzburg where he was jailed for eight months for the latest offence – which means together with the suspended sentence that will now be activated he needs to go to jail for 17 months.

He told the court: "I wanted to talk to the women."

But Judge Manfred Seiss said if he was in court for the first time his excuse might have been accepted, but after numerous court appearances he must have realised that what he was doing was wrong.

Five days after his release he purchased a newspaper and looked inside for the numbers of women who would put adverts there. Although he did not know them he would call up and say "hello, here is Thomas" or "hello, it's Hubert on the telephone".

The court heard that the man had never made threats or said anything particularly obscene although he did confirm that he had phoned up in the night, according to lawyer Roland Garstenauer, defending.

One of the victims told the court that it was extremely unpleasant to get the night-time calls and she had felt worried and lost sleep as a result. A second said that she felt the man was simply having a laugh at her expense.

The accused told the court that he was planning to get psychological help for his problem and he had already made an appointment. The court heard that the man would have liked to have been jailed in a psychiatric Institute but a sentence of this sort was only possible for somebody jailed for more than a year.

But the maximum sentence was stalking is one year and therefore he did not qualify – even though the fact that the two sentences together gave him more than a year inside.
