Cops lose appeal over migrant beating

By William Green

Four Vienna cops who left a Gambian man with broken bones after a vicious assault in his cell as he awaited deportation have lost an appeal against disciplinary sanctions over the actions.

The officers had appealed after a Chancellery high disciplinary commission ruled two of them should be sacked, a third fined five months’ salary and a fourth stripped of his pension and other benefits related to his work after the attack on Bakary J. in April 2006.

But the Administrative Court (VwGH) refused to act on the four men’s appeal and it was de facto rejected today (Fri).

Vienna police chief Karl Mahrer welcomed the news, saying it sent "a clear and important signal that assaults by police will not be tolerated."

In a separate court case four months after the incident three of the men were sentenced to eight months’ probation and the fourth to six months’ probation.
